These Terms are governed by the laws of New South Wales, Australia.
These terms apply to all website projects undertaken by Not A Cloud for clients, unless otherwise agreed in writing.
A 50% deposit is required before any work commences. The remaining 50% is due prior to launch or within 7 days of final delivery, whichever comes first. Late payments may result in delays to the project or temporary suspension of access.
The proposal outlines the agreed scope. Any additional features, pages, or revisions outside this scope may be quoted separately. The project includes up to 2 rounds of revisions. Further rounds will be billed at £20/$40 per hour.
The client agrees to provide all necessary content, assets, and approvals in a timely manner. Delays in content delivery or feedback may impact the timeline and proposed launch date. All imagery and written content supplied by the client must be owned or licensed by them.
Estimated timelines are provided in good faith but may vary depending on communication and asset delivery. Launch dates are scheduled based on timely feedback and payment completion. We aim to deliver projects generally within 4-8 weeks from receiving all assets.
Upon final payment, the completed website becomes the client’s property. Editable access to the CMS will be provided along with basic training or documentation. If the project is cancelled after work begins, the deposit is non-refundable.
At our discretion, a professionally licensed Webflow template may be used as the foundation for your website or certain pages. All templates are customised to suit your brand and content. Any associated licensing costs will be covered by Not A Cloud.
Hosting and domain registration are not included unless otherwise specified. If included, third-party costs (e.g., Webflow, Shopify, etc.) will be passed on directly to the client.
Bug fixes or small adjustments (e.g. typos, layout issues) will be covered a month post-launch. Any ongoing support, maintenance, or training can be quoted as an optional monthly or hourly package.
Not A Cloud is not liable for losses or damages resulting from website downtime, third-party plugin issues, or content provided by the client. We take care to deliver secure, modern websites but do not guarantee protection from cyberattacks, data loss, or other external factors.
Either party may cancel the project in writing. If cancelled after the project has commenced, the deposit is retained to cover time and resources already spent. Any completed work to date can be delivered upon request, provided that the cost of what work is completed is covered.
We reserve the right to display the completed sites on our social channels, our portfolio and promotional materials unless otherwise agreed in writing.
